This Disclaimer explains the limits of what MailMama Software LLC states, promises, and warrants in relation to its website, its services, and the information it publishes. It forms part of the Terms of Service.

1. Purpose and Scope

This Disclaimer applies to the website at https://mailmama.net/, to all content published on it, to marketing and informational material issued by MailMama Software LLC (“MailMama”, “we”, “us”, or “our”), to the hosted business email and email productivity services provided by MailMama (the “Service”), and to all communications made in connection with them.

It should be read together with the Terms of Service, the Privacy Policy, the Acceptable Use Policy, and the Refund and Cancellation Policy. Where this Disclaimer and the Terms of Service address the same subject, the Terms of Service control.

Nothing in this Disclaimer excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any liability that applicable consumer protection law does not permit to be excluded. Where you are a consumer, the exclusions here apply only to the extent permitted by the law of your country of residence.

2. General Information Only

Content published on our website, in our documentation, in help articles, in support responses, in blog posts, and in marketing material is provided for general information about the Service. It is not a substitute for the Terms of Service, is not a representation or warranty, and does not form part of any contract unless expressly incorporated.

We make reasonable efforts to keep published information accurate and current, but we do not warrant that it is complete, accurate, current, or free of error or omission. Information may become outdated, and features, limits, prices, and availability may change. In the event of an inconsistency between published information and the Terms of Service or the applicable order, the Terms of Service and the order control.

3. No Professional Advice

MailMama is a software and email hosting provider. It is not a law firm, an accounting firm, a tax adviser, a financial adviser, an insurance provider, a compliance consultancy, a certification body, a managed security services provider, or a payment institution, and it does not hold any licence or registration for such activities.

Nothing published by MailMama, and nothing stated by any member of our staff in support correspondence or otherwise, constitutes legal, tax, accounting, financial, insurance, regulatory, compliance, or cybersecurity advice. This includes any statement about data protection law, anti-spam law, electronic communications law, export control, sanctions, or the application of any statute to your circumstances.

References in our documents to statutes, regulations, and regulatory frameworks are included to identify our own obligations and the obligations we allocate between the parties. They are not a statement of what the law requires of you. You are responsible for obtaining independent professional advice on your own obligations, and for determining whether the Service is appropriate for your regulatory environment.

4. No Warranty as to the Service

The Service is provided on an “as is” and “as available” basis, as set out in the Terms of Service. To the maximum extent permitted by applicable law, MailMama disclaims all warranties and conditions, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and accuracy.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, that defects will be corrected, that the Service will meet your requirements, or that the Service will produce any particular business result. Feature descriptions describe functionality; they are not performance guarantees.

5. Availability and Uptime

MailMama does not publish and does not commit to any uptime percentage, availability target, restoration time, or response time, and no service credit regime applies, unless a separate written service level agreement has been executed between you and MailMama. Any statement about availability, reliability, or performance made on our website or in marketing material is a general description and not a commitment.

The Service may be unavailable or degraded as a result of scheduled or emergency maintenance, infrastructure failures, network conditions, attacks, actions of third-party providers, or events outside our reasonable control.

6. Email Delivery and Deliverability

MailMama does not guarantee that any message sent through the Service will be delivered, will be delivered within any particular time, will be accepted by a receiving network, or will be placed in a recipient’s primary inbox rather than a spam, promotions, quarantine, or junk folder.

Message delivery depends on factors outside our control, including the policies, filters, reputation systems, authentication requirements, and blocklists operated by receiving networks; the reputation and configuration of your domain and its authentication records; the content and structure of your messages; recipient behavior and complaints; and the actions of intermediate networks. Support for DKIM, SPF, and DMARC is provided so that you can authenticate your domain correctly. It does not guarantee delivery or inbox placement.

MailMama does not offer deliverability management, sender reputation management, blocklist remediation, or inbox placement services, and does not warrant any delivery rate, open rate, or engagement rate.

7. Spam, Virus, and Malware Filtering

Spam and virus filtering is provided as a feature of the Service. Filtering is probabilistic and is not a guarantee of protection. Unwanted, fraudulent, or harmful messages, including spam, phishing, business email compromise attempts, malware, and ransomware, may reach your mailboxes. Legitimate messages may be classified as spam and delayed, quarantined, or rejected.

MailMama is not a security provider and does not offer threat monitoring, managed detection and response, security operations, incident investigation, data loss prevention, or endpoint protection. You remain responsible for your own security controls, for training your users to recognize fraudulent messages, and for reviewing quarantine and spam folders.

8. Security

MailMama implements technical and organizational measures designed to protect the Service, as described in the Privacy Policy and the Data Processing Addendum. No service, network, or control can be guaranteed to be secure, and we do not represent that the Service is immune from unauthorized access, interception, compromise, or loss.

MailMama does not hold and does not claim any security certification, audit attestation, compliance accreditation, or framework compliance status, including any claim of SOC 2, ISO 27001, HIPAA, PCI DSS, or similar status, unless a specific certification is expressly identified in writing by MailMama. Statements that the Service is secure, private, encrypted, or protected are descriptions of the measures we apply and are not certifications, guarantees, or warranties.

Email is not an inherently confidential medium. Messages traverse networks and servers operated by third parties, and transport encryption between mail servers depends on the configuration of the receiving network. You should not transmit highly sensitive information by email without additional protection.

9. Backups and Data Loss

Operational backups are maintained for disaster recovery and service continuity. They are not a customer-facing archiving, retrieval, or electronic discovery service. MailMama does not undertake to restore individual messages, mailboxes, or accounts from backup on request, and backup retention periods are limited as described in the Privacy Policy.

You are responsible for maintaining your own copies of data that is important to you. MailMama does not warrant that data will not be lost, corrupted, or rendered unavailable.

10. AI-Assisted Features

Output generated by AI-assisted summaries, reply drafting, and similar features is produced automatically and may be inaccurate, incomplete, outdated, biased, misleading, or unsuitable for your purpose. It may misrepresent the content of a message, omit material information, or produce statements that appear authoritative but are incorrect.

AI-generated output does not constitute advice of any kind, is not reviewed by MailMama, and must be reviewed by you before it is relied on, acted on, or sent. MailMama does not warrant the accuracy, completeness, reliability, or fitness for purpose of AI-generated output and accepts no responsibility for decisions taken or messages sent on the basis of it.

The availability, behavior, and underlying technology of AI-assisted features may change, and the features may be modified or withdrawn as described in the Terms of Service.

11. Email Tracking

Email tracking data is derived from technical signals and is inherently unreliable. Opens and link interactions may be recorded where none occurred, for example where a security scanner, preview pane, or automated system loads message resources, and may fail to be recorded where they did occur, for example where a recipient blocks images or uses a privacy proxy. Tracking data should not be treated as evidence that a person read a message.

MailMama provides tracking as a technical feature and does not advise on whether your use of it is lawful. As set out in the Terms of Service and the Acceptable Use Policy, you are responsible for compliance with the laws applicable to you and to your recipients.

12. Third-Party Services and Non-Affiliation

The Service can interoperate with third-party email providers and other third-party services, including providers whose products are referred to by name in our documentation for the purpose of describing compatibility.

MailMama is not affiliated with, endorsed by, sponsored by, certified by, or an official partner or authorized integrator of any such provider, including Google, Microsoft, Apple, Yahoo, or any bank, payment provider, or financial institution, unless MailMama expressly states otherwise in writing. References to those providers do not imply any relationship between them and MailMama.

All trademarks, service marks, trade names, and logos referenced by MailMama are the property of their respective owners and are used only to identify the products and services with which the Service is compatible. Their use does not imply endorsement.

MailMama does not control third-party services and is not responsible for their availability, performance, security, data handling, pricing, changes, or discontinuation. A third-party provider may change its interfaces, restrict access, revoke authorization, or end compatibility at any time, which may cause a connected feature to stop working.

13. Plan Descriptions and Unlimited Features

Where a plan describes mailboxes, aliases, or domains as unlimited, that means that no fixed numerical cap and no per-user or per-seat fee applies to that feature. It does not mean that use is unrestricted. All use remains subject to the shared storage allocation, to the technical and fair-use limits published in our documentation, and to the Acceptable Use Policy, as set out in the Terms of Service.

Storage allocations are shared across the account and are measured in accordance with the method described in our documentation. Plan features, limits, and prices may change as provided in the Terms of Service.

14. Pricing, Taxes, and Product Information

Prices published on the website are exclusive of taxes. Applicable taxes are calculated and added at checkout or on the invoice based on the information you provide. Monthly equivalent figures shown alongside annual prices are presented for comparison only; billing is annual and the full annual amount is charged in advance.

We make reasonable efforts to ensure that pricing, plan descriptions, feature lists, screenshots, and availability information are accurate. Errors may occur. Where a material error is identified in a price or plan description before an order is fulfilled, we may decline or cancel the order and issue a full refund of any amount charged.

15. Forward-Looking Statements and Roadmap

Statements about planned features, future capabilities, intended integrations, or development timelines describe current intentions only. They are not commitments, do not form part of any contract, and must not be relied on in deciding whether to purchase. Planned features may be delayed, changed, or abandoned. Features described as beta, preview, early access, or experimental are provided as-is and may be withdrawn at any time.

16. Testimonials, Case Studies, and Results

Where customer testimonials, case studies, reviews, usage figures, or examples are published, they reflect the experience or circumstances of the individuals or organizations concerned at the time. They are not a guarantee, prediction, or representation that any other customer will achieve comparable results. MailMama makes no representation about productivity gains, time savings, cost savings, business outcomes, or any other result arising from use of the Service.

Our website and documentation may link to third-party websites and resources. Those links are provided for convenience. MailMama does not control, endorse, or assume responsibility for the content, accuracy, security, availability, or privacy practices of any linked site, and accessing them is at your own risk.

18. Geographic Availability and Company Presence

The Service is directed primarily to customers in the United States and is available to eligible customers in other countries, subject to applicable law, sanctions and export control requirements, infrastructure constraints, and the policies of third-party providers. Availability in any particular country is not guaranteed and may be restricted or withdrawn.

The address shown on our website and in our policies is the business mailing address of MailMama Software LLC. It is not represented as a staffed office, a customer service location, or a place to which correspondence other than formal notices should be sent. Nothing published by MailMama should be read as a claim about the number, location, or nationality of its personnel or management, or as a claim of approval, licensing, or endorsement by any government body, bank, or payment provider.

19. Limitation of Liability

The disclaimers in this document operate together with the disclaimer of warranties and the limitation of liability set out in the Terms of Service, which apply in full to the matters described here. To the maximum extent permitted by applicable law, MailMama is not liable for any loss or damage arising from reliance on published information, from non-delivery or misdelivery of messages, from filtering outcomes, from unavailability of the Service, from loss of data, from the output of AI-assisted features, from tracking data, or from the acts, omissions, or discontinuation of any third-party service.

We may update this Disclaimer to reflect changes to the Service, to our published information, or to legal requirements.
